1. Acceptance of Terms

By accessing or using Macademia ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including nutrition professionals, dietitians, and any other visitors.

2. Description of Service

Macademia provides a platform for nutrition professionals to manage patient records, create meal plans, track dietary intake, schedule appointments, and perform nutritional analyses. The Service is intended for use by licensed or credentialed nutrition professionals only.

3. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You must be at least 18 years old to create an account

4. Professional Responsibility

Macademia is a tool to assist nutrition professionals in their practice. It does not replace professional judgment. You remain solely responsible for:

• All clinical decisions made using information from the platform
• Verifying the accuracy of nutritional data and meal plans
• Ensuring compliance with applicable healthcare regulations
• Obtaining appropriate patient consent for data entry and storage

5. Patient Data & Privacy

You are the data controller for any patient data you enter into the platform. You agree to:

• Only enter patient data for which you have proper authorization
• Comply with all applicable data protection laws (HIPAA, GDPR, etc.)
• Not use the Service to store data beyond the scope of your professional practice

6. Subscription & Billing

• Paid plans are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We reserve the right to change pricing with 30 days' notice
• Failure to pay may result in suspension or termination of your account
• Free trial periods, if offered, automatically convert to paid plans unless cancelled

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with unauthorized third parties
• Use the Service to store data unrelated to nutrition practice

8. Intellectual Property

The Service, including its design, features, and content, is owned by Macademia Inc. and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your professional practice. Any data you enter remains your property.

9. Limitation of Liability

To the maximum extent permitted by law, Macademia Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may cancel your account at any time through your account settings. Upon termination, you may request an export of your data within 30 days, after which it may be permanently deleted.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware.
